There's a lot of chatter around at the moment with some excited commentaries and research suggesting that trademark owners are getting more combative and willing to challenge new trademark applications. The last official figures from the UK Intellectual Property Office suggest, according to World Trademark Review's analysis, that the number of successful challenges is simply increasing in line with the number of actual applications. What is certainly true is that in an increasingly crowded brand space, it's really important to verify the trademark position before going live with a new product or company name, as Radio X has recently discovered.
So, while the number of objections are indeed up, so too are the number of applications and the number of applications registered – and an expanding register and rocketing application levels will naturally lead to a rise in conflicts. The takeaway is not that brands are getting tougher in their oppositions activity, merely that they are remaining as vigilant as in previous years.
